1. CATEGORIES AND TYPES OF PERSONAL DATA PROCESSED

Our company processes the following personal data within the scope of providing boat rental services:

  • Identity Information: Name, surname, Turkish Republic ID number, passport number (for foreign customers), date of birth, signature circular/declaration. 

  • Contact Information: Address, email address, mobile phone number, KEP address.

  • Financial Information: Bank account information (IBAN), credit card information (masked), payment and invoice information, provision amounts.

  • Legal Transaction Information: Boat charter agreement, undertakings, information on lawsuit/enforcement files in case of dispute.

  • Operation Security Information: IP address, website login and logout logs, password and login information, log records.

  • Location Information: GPS/location data for navigation safety and tracking of the rented boat. 

  • Visual and Audio Recordings: Damage assessment photographs included in the boat delivery/return reports, security camera recordings taken at office/marina entrances for security purposes (Audio recording is not taken). 

2. PURPOSES OF PROCESSING PERSONAL DATA

Your personal data is processed for the following purposes, in accordance with the general principles in Article 4 of the Law (compliance with the law and rules of honesty, specific, clear and legitimate purposes, proportionality):

  • Execution of Goods/Services Sales Processes: Establishment of boat rental agreements, making reservations and performing the service. 

  • Execution of Financial and Accounting Operations: Issuing invoices, collecting payments, refund processes.

  • Following Up and Executing Legal Affairs: Fulfilling the burden of proof in possible disputes, complying with requests from authorized institutions.

  • Informing Authorized Persons, Institutions and Organizations: Making legal notifications to the Port Authority, Coast Guard and Law Enforcement Agencies (KBS/GİYKİMBİL etc.). 

  • Customer Relationship Management: Tracking requests and complaints, providing after-sales support services.

  • Information Security Process Implementation: Ensuring the security of the company's online platforms.

  • Marketing Activities (Subject to Explicit Consent): Conducting marketing processes for products/services, campaign and promotion information. 

3. METHOD AND LEGAL GROUNDS FOR COLLECTING PERSONAL DATA

Your personal data is collected through our website, mobile application, call center, physical forms in our offices, e-mail and boat delivery records; wholly or partially through automated means or through non-automated means as part of a data recording system.

These data are processed based on the following legal grounds specified in Article 5 of the Law:

  1. Explicitly Provided for in the Laws and Legal Obligation (Article 5/2-a and ç): Fulfillment of our obligations (issuing invoices, reporting identities, etc.) under the Identity Reporting Law No. 1774, the Tax Procedure Law and the Turkish Commercial Code.

  2. Establishment or Performance of the Contract (Article 5/2-c): Identity and financial data required for the conclusion of the boat charter contract, confirmation of the reservation, and collection of fees. 

  3. Establishment, Exercise, or Protection of a Right (Article 5/2-e): Preservation of contract and transaction records as evidence in possible legal disputes.

  4. Legitimate Interest of the Data Controller (Article 5/2-f): Without prejudice to your fundamental rights and freedoms; ensuring company security (camera recordings), improving service quality and the sustainability of commercial activity. 

  5. Explicit Consent (Article 5/1): Your explicit consent is also requested for situations requiring marketing, profiling and (if any) international transfer. The provision of the service is not conditional on the granting of explicit consent for marketing purposes. 

4. TRANSFER OF PERSONAL DATA

Your personal data will be transferred in accordance with Articles 8 and 9 of the Law;

  • Within the Scope of Legal Obligations: To authorized public institutions and organizations such as the Coast Guard Command, Port Authorities, General Directorate of Security, Tax Offices, Courts and Enforcement Offices,

  • Within the Scope of Service Provision: To banks and payment institutions for the purpose of carrying out payment transactions; to insurance companies for the insurance of the boat;

  • Within the Scope of Operational Processes: To the server/software companies and financial advisors from whom we receive IT infrastructure support,

may be transferred. 

Note: Your personal data is not transferred abroad without your explicit consent or without ensuring the adequate protection conditions stipulated in Article 9 of the Law. 

5. WARNING ABOUT DATA SECURITY AND INTERNET TRANSACTIONS

Our company takes the necessary technical and administrative measures to ensure the security of your personal data. However, you are also responsible for ensuring the security of your passwords and login credentials, protecting your devices against virus/trojan (keylogger, etc.) threats, and being vigilant against phishing attacks when conducting transactions through our online platforms. It is important that you contact our company immediately in suspicious situations.

  • To learn the purpose of processing personal data and whether it is being used in accordance with its purpose,

  • To know the third parties to whom personal data is transferred, domestically or abroad,

  • To request the correction of personal data if it is incomplete or inaccurate,

  • To request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the Law,

  • The right to request notification of correction, deletion, and destruction processes to third parties to whom personal data has been transferred,

  • The right to object to a result that is detrimental to the individual arising from the analysis of processed data exclusively through automated systems,

  • The right to demand compensation for damages incurred as a result of the unlawful processing of personal data.

Our company will process the request free of charge as soon as possible and at the latest within 30 (thirty) days, depending on the nature of the request. However, if the process requires additional costs, the fee specified in the tariff determined by the Personal Data Protection Board may be charged.
